Terms & Conditions

By installing or using the CarouselCutter Photoshop Plugin (“the Plugin”), you agree to these Terms and Conditions (“Terms”). Please read them carefully. If you do not agree to any part of these Terms, do not use the Service.

1. Acceptance of Terms

Your access to and use of the Plugin’s full functionality, including the activation of a license, is conditional upon your acceptance of these Terms. Before first activating or using the full features of the Plugin, you will be required to explicitly acknowledge and consent to these Terms and our Privacy Policy. Without such explicit consent, access to the Plugin’s full features will not be granted. Your continued use of the Plugin implies your ongoing acceptance of any updates to these Terms.

2. Description of the Service

Carousel Cutter is an Adobe Photoshop User Experience Platform (UXP) plugin designed to help users create multi-tile image carousels, particularly for platforms like Instagram. The Plugin enables you to slice a single image into multiple, perfectly aligned tiles based on specified aspect ratios and slide counts, and then export these tiles as individual image files.

The Plugin operates on a freemium model. It offers a free trial with a limited number of uses. To unlock unlimited use and access all features, users can purchase a lifetime license.

The Plugin integrates with our backend services (powered by Firebase) solely for the purpose of managing license activations and tracking free trial usage.

3. User Accounts, License Acquisition & Data Handling

a. Eligibility
You must be at least 16 years old to use the Plugin.

b. License Acquisition & Activation
The Plugin does not require traditional user account registration or login within the Plugin interface. Instead, the Plugin identifies your machine using a unique hashed machine ID (a SHA-256 hash generated locally on your machine and stored on your local file system, with the hash sent to our server).

To access unlimited use of the Plugin, you must acquire a lifetime license. Payments for lifetime licenses are processed securely via Stripe. We do not store any of your payment details; all payment processing is handled directly by Stripe. Upon successful purchase, a unique license key will be sent to the email address provided during the purchase.

To activate your license, you must enter this license key into the Plugin’s designated field. Verification of license keys and management of machine activations are handled securely via our Firebase backend.

c. Data Handling
For the purposes of license management and trial tracking, we store the following data in our Firebase Realtime Database:

  • Your hashed machine ID.

  • Your email address (provided during license purchase).

  • Your license key.

  • Activation records (including timestamps) linked to your license key and hashed machine ID.

  • Trial usage counts and last used timestamps linked to your hashed machine ID.

This data is used solely for the functionality described above and in more detail in our Privacy Policy. We do not perform any user behavior tracking or collect personal data beyond what is strictly necessary for license management and the freemium trial features.

Hashed machine IDs and associated trial usage data are retained for the duration of the trial and a limited period thereafter to prevent abuse of new trials. License data (key, email, activations) is retained for the duration of your license and for legal/accounting purposes. For detailed information on data retention, please refer to our Privacy Policy.

4. User Responsibilities

By using the Plugin, you agree to:

  • Use the Plugin in compliance with all applicable laws and regulations, including copyright laws.

  • Provide accurate and complete information when purchasing a license.

  • Not misuse or interfere with the Plugin’s functionality, our backend services, or the license validation process.

  • Not attempt unauthorized access, reverse-engineer, decompile, or disassemble any part of the Plugin or its underlying code.

  • Respect our licensing terms, including the maximum number of machine activations allowed per license.

5. Intellectual Property

All intellectual property rights related to the Plugin, including but not limited to copyrights, trademarks, and trade secrets, are owned by VisualsofJulius OY.

You are granted a non-exclusive, non-transferable, revocable license to use the Plugin solely for your personal or commercial use in conjunction with Adobe Photoshop, subject to these Terms and the terms of your purchased license (e.g., lifetime access).

You may not copy, modify, distribute, sell, lease, reverse-engineer, or create derivative works from any part of the Plugin.

6. Termination & Data Removal

a. License Revocation
Licensed users may voluntarily revoke a license activation from a specific machine at any time directly within the Plugin. Revocation will remove that specific hashed machine ID from your license’s active activations, freeing up a seat for activation on another machine.

b. Data Deletion
Your hashed machine ID and associated trial usage data are retained as long as necessary for the trial management and for a limited period thereafter as outlined in the Privacy Policy.
If you purchase a license, your email, license key, and activation data will be retained for the duration of your license and for legal and accounting obligations.

Users may request deletion of their personal data (excluding data we are legally obliged to keep) by contacting us via the contact information provided in Section 11.

c. Service Termination by Us
We reserve the right to suspend or terminate your access to the Plugin immediately, without prior notice, if you breach these Terms, misuse the Plugin, or attempt to circumvent its licensing mechanisms. In such cases, no refund will be issued.

7. Refund Policy

For lifetime licenses, refunds are generally not offered after purchase, as the license key is immediately provided and grants access to the full functionality.

However, if you experience a technical issue that prevents the Plugin from functioning as advertised and we are unable to resolve it within a reasonable timeframe, you may be eligible for a refund within [e.g., 14 or 30] days of purchase.

8. Limitation of Liability

THE PLUGIN IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. VISUALSOFJULIUS OY DOES NOT WARRANT THAT THE PLUGIN WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VISUALSOFJULIUS OY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE PLUGIN; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE PLUGIN; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR DATA.

IN NO EVENT SHALL THE AGGREGATE LIABILITY OF VISUALSOFJULIUS OY EXCEED THE AMOUNT YOU HAVE PAID TO US FOR THE LICENSE TO THE PLUGIN.

9. Compliance with Third-Party Services

By using the Carousel Cutter Plugin, you also agree to the terms and policies of the following third-party services that are integrated with or necessary for the Plugin’s operation:

  • Adobe Inc.: The Plugin operates within Adobe Photoshop. Your use of Photoshop and the UXP platform is subject to Adobe’s own Terms of Use and Privacy Policy.

  • Google Firebase (Google Cloud Platform): Our backend services for license management and trial tracking utilize Google Firebase. Your data processed via Firebase is subject to Google’s Terms of Service and Privacy Policy.

  • Stripe Inc.: Payments for lifetime licenses are handled directly via Stripe. All transactions comply with PCI-DSS security standards. We do not store any payment details. Your payment data is subject to Stripe’s Terms of Service and Privacy Policy.

  • Google GMail (via Nodemailer): Email delivery for license keys uses GMail. Your email data used for this purpose is subject to Google’s Terms of Service and Privacy Policy.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Finland, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or the Plugin shall be resolved exclusively in the courts of Finland.
